1. What is the penalty for deliberate falsification of entries in the DTR? Any ruling relative to salary deductions for tardiness and undertime inccurred by employee?

On salary deduction please see CSC Resolution No. 02-766 dated May 28, 2002 (Lalao, Usop M.) cited is Section 34 of the Omnibus Rules on Leave and Section 56 thereof. As to recording of attendance of government workers, I is provided in CSC MC No. 21 dated June 4, 1991 letter C thereof by the use of bundy clock and other records of attendance as long as they are kept in the proper form. As to penalty for falsification of DTR, please see the SC ruling in the case of Ofice of he Ombudsman vs. Torres (GR No. 168309 dated January 29, 2008).

2. Whether the disciplining authority has the discretion to exclude any of the accessory penalties in the execution of the penalty of dismissal from the service?

Accessory penalties are inherent in principal penalties. Thus, in case of the principal penalty of dismissal from the service, the accessory penalties of cancellation eligibility, forefeiture of retirement benefits, perpetual disqualification from holding public office and bar from taking civil service examinatios are inherent, and automatically imposed by law. As such, it cannot be excluded. As to your second query, it is opined that the Review and Compliance Committee may be organized through the branch level of the Pag-IBIG Fund, which shall include as member thereof, among others, the Chief/Head of Personnel/Administrative Division or Unit/Human Resource Management Office (HRMO) of the branch office.

Good day!

I just want to ask for the penalty or is there a penalty for this scenario. If 2 doctors (siblings) working in the municipality, one is holding a permanent position covering the schedule of her brother who is under contract of service and the salary of the contractual employee is collected and owned by the permanent employee would you consider it as double compensation?

Please take note of Misconduct. It is “a transgression of some established and definite rule of action, more particularly, unlawful behavior or gross negligence by a public officer.” The misconduct is grave if it involves any of the additional elements of corruption, wilful intent to violate the law or to disregard established rules, which must be established by substantial evidence.
