I would like to know the elements of Habitual Tardiness in Reporting for Duty Causing Prejudice to the Operations of the Office, a new grave offense under Rule 10 - B of the 2017 RACCS. How does this differ with Habitual Tardiness under Rule 10 - F of the same Rules. Illustrative Case: The Cashier of a Regional Office incurred tardiness of six (6) or more times for seven (7) months in a year [6, 10, 9, 8, 9, 8, & 8]. Could this habitual tardiness fall under Rule 10 - B, despite not meeting the 10 times of more requirement for habitual tardiness under the old CSC rules? Thanks po!

As a matter of policy, this Office refrains from rendering categorical opinions on matters and issues that may later on be the subject of an administrative proceeding before the Commission either by means of an appeal or a complaint. This is to preclude the possibility of prejudgment should an actual administrative case be commenced or instituted based on the said matters or issues.
Nonetheless, as to your concern, Habitual Tardiness under Rule 10 (F), 2017 RACCS pertains to Frequent Unauthorized Tardiness (Habitual Tardiness) as one committed by an official or employee who incurs tardiness regardless of number of minutes, ten (10) times a month for at least two (2) months in a semester or at least two (2) consecutive months during the year.
Meanwhile, habitual tardiness in reporting to duty causing prejudice to the operations of the office pertains to tardiness committed by an official or employee regardless of the number of tardiness in a semester or a year for as long as he/she is required to do a task/duty and he/she failed to do said task/duty by reason of his/her tardiness resulting to damage or prejudice to the transaction or operation of the office.
