Sa kinauukulan,

Magandang araw po!

Ako po ay isang kawani ng gobyerno dito sa Pampanga. Nais ko po sanang dumulog sa inyong tanggapan upang humingi ng payo. Ito po ay tungkol sa aking kasamahan sa trabaho. Meron po akong natatanggap na balita na my sinasabi itong tao na ito kapag ako ay nakatalikod kung kaya't ang aking ginawa ay nag record po ako upang makumpirma kung ito ay totoo. Buhat po sa record na iyon narinig ko na sinabi nya sa bagong pasok naming empleyado na ako daw po ay mahilig mag inarte at antayin lang daw po nito ang mga ilang buwan at malalaman nito ang aking pag-uugali o ang aking tunay na pagkatao.Meron rin po akong nalaman na kapag ako ay nakatalikod ay sinasabihan rin nya ako ng "malandi", bukod pa po sa iba pa niyang parinig at pagdadabog. Hindi po ako nagsasalita dahil ayoko pong humaba pa ang isyu, pero dahil po sa nalaman ko ay parang hindi naman po tama na ako ay ipamalita, ako ay siraan at mandamay ng iba upang pumangit ang tingin sa akin ng iba kong kasamahan. Pakiramdam ko po ako ay napagtutulungan sa aming opisina dahil sa maling impormasyon tungkol sa akin. Nais ko po siyang ireklamo upang matigil po ang kanyang maling ginagawa.

Ang tanong ko po ay:

1. Kung may basehan po ba kung siya ay aking irereklamo sa aming opisina o may grounds po ba sa aking pagrereklamo?

2. Ano po ba ang maaring penalty sa kanya kung ako ay magrereklamo?

3. Sa parte ko po ba, meron din po ba akong pananagutan sa tinatawag na "Right to Privacy" kahit na ang aking motibo ay upang mapatunayan lang na meron nga siyang sinasabi na hindi maganda ukol sa akin?

Ako po ay umaasang inyong matulungan sa aking hinaing.

1. Kung totoo ang sinasabi mo, puede mo siyang kasuhan ng 'Simple Misconduct'.

2. Ang penalty ay one (1) month and one (1) day suspension to six (6) months for the first offense.

3. Ang puede mong gamiting na ebidensiya laban sa kanya ay mga testimonya galing sa mga ka-opisina mo na nakarinig sa kanya.

mag file po ako sa grievance dito sa aming opisina o pede ko pong idiretso sa civil service regional office po?

Under Section 12, Rule 3 of the Revised Rules on Administrative Cases in the Civil Service provides that an administrative complaint may be filed at anytime with the Commission or any of its Regional Offices, heads of departments, agencies, provinces, cities, municipalities and other instrumentalities.

However, please take note to exhaust first the available administrative remedies by filing before your agency or to our regional office having jurisdiction over your agency.

Oo, Ang pag-re-record na walang pahintulot ay isang criminal offense sa ilalim ng RA 4200.
