Question Loafing/Sleeping during office hours

Good afternoon Sir/Mam. I would like to seek your opinion regarding disciplinary cases. Is loafing and sleeping during office hours two different offenses or are they categorized as the same type of offense? What if the employee was caught by the agency head sleeping during office hours, can the agency head automatically sanction the employee in accordance with the penalties stated in the Rules on Administrative Cases in the Civil Service after the employee was directed to explain in writing, and, the written explanation was considered unacceptable by the head? Is there a need to file formal complaint and undergo investigation even if the agency head was the complainant?

Please advise.

Action Officer replied the topic: Loafing/Sleeping during office hours
Please be informed that under Sec. 50, Rule 10, 2017 Rules on Administrative Cases in the Civil Service (2017 RACCS), the offense of Loafing from Duty During Regular Office Hours is considered as a grave offense whereas sleeping during office hours is an act violative of office rules and regulations, is a light offense. Thus, loafing and sleeping during office hours, constitute two separate offenses.

Further, in determining the culpability or non-culpability of an employee in an administrative case, due process must be observed following the procedures set under the 2017 RACCS and other applicable Laws and rule.
