Hi!

I currently work here in our LGU and we are facing different challenges especially to those employees who are stubborn when it comes to following orders from the Mayor. We do not formulate yet our Local Disciplinary Board since not everyone around has knowledge to the process of such. As much as we would like to take actions about the issue, we are hesitant to do so even we have this RRACS because we might misinterpret the laws or provisions indicated therein. What would be the best remedy to address the issue of insubordination within our municipal level?

We are hoping that the honorable commission will give us immediate attention and have their opinion in an earliest possible time.

Before we respond to your query, please be informed that as a matter of policy the Commission does not render opinions or rulings on issues that may eventually be the subject of court litigation or appeal before it. This is especially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case. Nonetheless, as an initial action, you may consider issuing a Memorandum to the employee concerned. The said Memorandum should contain the findings or allegations against the employee and at the same time, give the employee opportunity to answer the same.
