MAGANDANG ARAW!

magtatanong lang po. im presently working sa isang munisipyo sa office of the vice mayor.
i was appointed as a records officer 1 last feb 2015...di ko alam ang proseso ng appointment sa government, since sa private ako galing.
ang appointing officer ko was the MAYOR. then, last august 2016, i was designated as SB SECRETARY by the VICE MAYOR.
later ko na lang nalaman na dapat pala ang appointing officer ko is the VICE MAYOR since nasa legislative office ako.
QUESTION: IS MY APPOINTMENT VALID?

Hi,
Based on your letter-query, you were only designated as SB Secretary. Designation is merely temporary in nature and can be revoked at anytime. Further, it does not require issuance of an appointment by the Vice Mayor. An Office Order will suffice.

Im sorry let me clarify. I was appointed as Records Officer 1 by the Municipal Mayor but I am under the office of the Vice Mayor. Tama ba ang appointing officer ay mayor? I was designated as SB Secretary thru an Office Order. Then follow up question: May expiration ba ang designation sa akin? Natalo ang VM na nag designate sa akin. What will happen to my position as OIC-SB Secretary. Thank you

Hi,

Section 444(b)(1)(v), Article I Chapter III, Title II, Book III, R.A. 7160 provide, that:

Section 444. The Chief Executive: Powers, Duties, Functions and Compensation. -
xxx
(b) For efficient, effective and economical governance the purpose of which is the general welfare of the municipality and its inhabitants pursuant to Section 16 of this Code, the municipal mayor shall:
(1) Exercise general supervision and control over all programs, projects, services, and activities of the municipal government, and in this connection, shall:

(v) Appoint all officials and employees whose salaries and wages are wholly or mainly paid out of municipal funds and whose appointments are not otherwise provided for in this Code, as well as those he may be authorized by law to appoint
xxx

As earlier advised, Designation is merely temporary in nature and can be revoked at anytime. Further, it does not require issuance of an appointment by the Vice Mayor. An Office Order will suffice.

Once revoked, the designated officer shall cease to function as such. However, he/she shall continue to function as provided in his/her PDF in line with the position to which he/she had been appointed to.
