Hi. I would like to clarify if the Alternative dispute resolution as defined under RA 9285 is same with the Grievance Machinery under CSC rules. Please explain. Thank you

Hi,

Please be clarified that ADR under RA 9285 is not the same as the grievance machinery under CSC MC No. 2, s. 2001.

ADR or Alternative Disputes Resolution is a term that refers to different modes of settling disputes other than through court litigations, such as negotiation, mediation, conciliation, arbitration, or a combination of any of two or more of the following.

On the other hand, Item 6 of the CSC circular provides that the grievance machinery under the CSC circular is a mechanism provided for the settlement of work-related grievances (not disputes) giving rise to employee dissatisfaction, i.e.:

1. Non-implementation of policies, practices, and procedures on economic and financial issues and other terms and conditions of employment fixed by law including salaries, incentives, working hours, leave benefits, and other related terms and conditions.
2. Non-implementation of policies, practices, and procedures which affect employees from recruitment to promotion, detail, transfer, retirement, termination, lay-offs, and other related issues that affect them;
3. Physical working conditions;
4. Interpersonal relationships and linkages; and
5. Protest on appointment and other personnel actions; and
6. All other matters giving rise to employee dissatisfaction and discontentment outside of those cases enumerated in Item No. 6.
