My friend is a newly-hired government personnel. She opted to file for a special privilege leave 21 calendar days after assumption of duty. HR Division dissapproved it saying she needs to be in service for at least 6 months before she could be entitled to a privilege leave.

Any insight on this matter?

Section 21, CSC Memorandum Circular No. 40, s. 1998 dated December 24, 1998 (Rules on Leave), granted Special Leave Privilege (SLP) to government officials and employees without regard as to when they were initially employed in the government service. Thus, your friend may inquire from his/her agency for the basis in requiring him/her to be employed therein for at least six (6) months. Thanks.

hi there. in our office, we implement CSC MC 20s. 1996 which specifies that SLP can be enjoyed after six months of continuous service. CSC MC 40 s. 1998 is about omnibus on rules on appointment not about leave. pls clarify. thanks

Thank you for the correction, it should be Section 21, of CSC MC No. 41, s. 1998 dated December 24, 1998. Please take note that the Commission stated in said MC No. 41 that "all existing Civil Service rules and regulations, Circulars and Memoranda inconsistent with these Rules are hereby repealed or amended accordingly."
