per CSC memo No. 18 s. of 2016 Policy Guidelines on the 3 Salary Grade Limitation on Promotion. My query would be this scenario. The Field Office of a certain Agency is now undergoing reclassification. All of those operating in Municipalities is assured to become SG 22 Officers with RATA equivalent to a Division Head. The Next Officer Operating in the Province or Municipality are Salary Grade 13; if there is a City the Next Officer is SG 15, he or she could only be 1 or in a case of Albay 3. At the Regional Office there are Officers holding SG 20 ( excluded in Reclassification), SG 18 and SG 13. If a vacancy occurred in a Municipality of Province A and with the limitation on the memo, do the so called next in rank are those in SG 13 operating in the Province and Municipalities or those in the Regional Office with SG 20? Do the very wide discretionary authority of the Appointing Authority will prevail in case no waiver from the SG 20 from Regional Personnel been signed and the AA appoints the SG 13 or the other low SG operating in the Province?

Please be informed that as a matter of policy, the Commission does not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is so especially when there are material facts necessary to the judicious adjudication of the issues which are not fully represented or substantiated as in this case. Nonetheless, regarding your query, please be informed that it may be that the next in rank are those holding SG 13 positions depending on the organizational chart of the agency concerned. however, in accordance with the merit and fitness rule, the qualification standards must be met by the applicant. Also, the appointing authority is given a wide latitude of discretion to ascertain who among the qualified applicants is the best fit for the job. thank you.
