Question Deficiency in Skills Eligibility - Category II

Good Morning.

Our office posted a vacancy with the following minimum qualification requirements:
Education: Completion of two (2) years studies in college or high school graduate with relevant vocational or trade course
Experience: One (1) year relevant experience
Training: Four (4) hours relevant training
Eligibility: xxxxxxxxxx (MC 11, s. ’96 – Cat II)

After the initial screening, applicants who did not have the 'Skills' Eligibility (MC 11, s. 96 - Cat II) were excluded from further processing / evaluation.

My questions are as follows:
1. Can an applicant who has Civil Service (Professional) eligibility appeal that he/she still be included in the selection process if he/ she is willing to acquire the Skills eligibility if he/she is chosen for the position? (I acknowledge that the CSC has pointed out that Civil Service eligibility is different from Skills eligibility.)

2. Still referring to the above scenario, Can the applicant be considered, and if ever he/she is found to be the 'most suitable' candidate, be granted only a 'temporary' appointment until he complies with the Skills Eligibility?

3. In order to obtain the Skills Eligibility (Category II), the CSC ruling states that he/she has to complete one (1) year of Very Satisfactory actual work performance. If the applicant has worked for more than a year (but under a contract of service arrangement, meaning there was no employee-employer relationship), but he/she can secure a VS rating during this period, will this be sufficient?
(Assuming that during this engagement, he/she had actually 'applied' the technical skills that were required).

As basic policy principle in the government that employment in the government is in strict compliance with the rules on and merit and fitness, please be informed that agencies HRMDOs should strictly follow and observe rules in appointing the qualified person to a particular position. The apppointee should possess the minimum qualification standards (QS) set-forth for the subject the position. Inability to possess any of the required QS shall be a valid ground for disqualification to the position or even disapproval/invalidation of an appointment issued by the agancy.
