Dear Mr. Santos:

This refers to your query on whether a government employee can be allowed to report to work pending his/her request for extension of service with the CSC, and who is responsible for his/her salaries if the employee is allowed to continue to render service.

Please be informed that the Commission does not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is so especially when there are material facts necessary to the judicious adjudication of the issue which are not fully represented or substantiated as in this case.

Nonetheless, your attention is invited to Section 129 (6), 2017 Omnibus Rules on Appointments and Other Human Resource Actions[/b] which provides that the only basis for Heads of Offices to allow an employee to continue rendering service after his/her 65th birthday is a Commission Resolution granting the request for extension. In absence of such resolution, the said employee shall not be authorized to perform the duties of the position and his/her salaries shall be the liability of the official responsible for the continued service of the employee.”
