Base on Section 27 of Rule XVI of Book V of EO No. 292 or Section 27 of CSC MC # 41 SERIES OF 1998 as amended by MC No. 14 s. 1999, "Computation of vacation and sick leave shall be made on the basis of one day vacation leave and one day sick leave every 24 days of actual service using the tables of computations as follows".

Query;
1. What does "24 days of actual service" means?
2. Is the 1.25 day per month creditable regardless if the employee incurred any number of vacation or sick leave days during the month?

Good day! As a matter of policy, the Commission does not render opinions or rulings on queries that may eventually be the subject of a complaint or case especially so if the materials facts are not so presented as in this case. Nonetheless, we refer to your first query on what does "24 days of actual service" means. It would simply mean that on the 24th day of actual service (no tardiness or undertime), an employee earns an equivalent of one day leave credit.

As regards your second query, on whether the 1.25 day per month creditable regardless if the employee incurred any number of vacation or sick leave days during the month, the answer is in the affirmative.

Query:
1. How is the VL & SL credits earned computed upon assumption of duty if the date of assumption is (a) May 1 and (b) May 30?

I just need some clarification on this matter.

Good day! Nonetheless, computation of vl and sl shall be made on the basis of one day vacation leave and one day sick leave for every 24 days of actual services rendred. If the employee's assumption to duty falls on May 1 which is considered as a holiday, said date is included in the 24 days actual services rendered.

As a matter of policy, the Commission does not render opinions or rulings on queries that may eventually be the subject of a complaint or case especially so if the materials facts are not so presented as in this case. Nonetheless, you may reflect on the rule with regards to the deduction of tardiness and undertime under Section 34, Omnibus Rules on Leave, as amended which provide, as follows:

"Sec. 34. Tardiness and undertime are deducted against vacation leave credits. — Tardiness and undertime are deducted from vacation leave credits and shall not be charged against sick leave credits, unless the undertime is for health reasons supported by medical certificate and application for leave."
