Hi,

May I seek opinion on the interpretation and implementation of Section 6 of R.A. 6656 where it provides for composition of the Placement Committee.

The law says that there should be 2 representatives from the 1st & 2nd level positions to be elected by the employees and another from the Employees Association. How should the election contemplated be implemented if there is already a recognized employees association representing at least 90% of the rank and file employees as members thereof? Should it be the employees association who will designate the composition of the Committee in the same manner as in other representations such as those provided in ORA OHRA?

Anent hereto, does the agency have discretion to add additional members to the Placement Committee? If so, how would the balance of representation be maintained?
