Good day Sir.

As a matter of policy, this Office refrains from rendering categorical opinions on matters and issues that may later be a subject of an administrative proceeding before the Commission either via an appeal or a complaint. This is to preclude the possibility of prejudgment should an actual administrative case be commenced or instituted based on the said matters or issues.

Nevertheless, to shed light on the matter, the Commission hereby clarifies that the policy on WFH arrangement was issued to address the situation of agencies located in areas under Enhanced Community Quarantine (ECQ) and Modified Enhanced Community Quarantine (MECQ). Meanwhile, agencies located in areas placed under General Community Quarantine (GCQ) and Modified General Community Quarantine (MGCQ) may adopt four-day workweek in combination with other AWAs, provided that the required 40-hour workweek is complied with.

Employees who may avail the WFH WFH are those vulnerable workers. These are employees below 21 years old and 60 years old and above, as well as those with immunodeficiency, comorbidity, or other health risk, and pregnant women, and those who live in ECQ, MECQ, GCQ, and MGCQ areas, except when their services are indispensable under the circumstances or when office work is permitted. Those living with persons with immunodeficiency, comorbidity, or other health risk may also choose to adopt this type of AWA in areas under ECQ, MECQ and GCQ.

Accordingly, nothing contained in the policy that WFH extends to situations wherein employees encountered difficulty in reporting to work due to heavy rains or other calamities.

I have another question, Sir/Maam, related to the Work from Home scheme during an MGCQ period. Can an employee, upon approval of the agency head, be allowed to avail of alternative work arrangement (say, 4 days physical reporting + 1 day work from home) for reasons of difficulties in public transport?
