Question Effectivity of Appointment

A person has been appointed to a position in a local govt unit but he only knew of the appointment 16 days after the date of the appointment. While he did not know about the appointment, he continued working in a national agency. After knowledge of the appointment, he still has to submit his resignation notice and prepare his clearances with the national agency. Is there a required number of days for him to assume office in the LGU given the number of days that has already lapsed as stipulated in the date of appointment and the time he will be processing for his clearances?

Relevant to your query is CSC Memorandum Circular No. 40, Series of 1998, Revised Omnibus Rules on Appointments and Other Personnel Actions, thus;

Rule VI
Submission, Approval/Disapproval of Appointment
Section 1. x x x
If the appointee does not assume office within thirty (30) calendar days from the receipt of the approved appointment[/u], the same may be cancelled by the appointing authority and reported to the Commission for record purposes. x x x.
