What if a permanent employee of a CSC-covered government agency is detailed or seconded to a government agency or entity not covered by CSC, would the CSC rules on detail and secondment strictly govern the terms and conditions of the temporary transfer? Thank you.

Good day, Maam!

Please be informed that as a policy, the Commission does not render opinions/rulings on issues that may eventually be the subject of a complaint or appeal before it. This is especially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case. Nevertheless, we will cite the pertinent provision/s under the Civil Service rules and applicable jurisprudence that will best answer your query/ies.

The civil service embraces all branches, subdivisions, instrumentalities, and agencies of the Government, including government-owned or controlled corporations with original charters. (Section 2 [1], Article IX-B, 1987 Constitution)

Detail — temporary movement of an employee from one department or agency to another which does not involve a reduction in rank, status or salary. (Sec. 13 , Rule IV, 2017 Omnibus Rules on Appointments and Other Human Resource Actions (2017 ORAOHRA) (Revised July 2018) (CSC Resolution No. 1800692 dated July 3, 2018)

Secondment may be classified as follows:

a. Inter-department secondment – movement of an employee from one department or agency to another.
b. Intra-department secondment – movement of an employee from one agency or bureau to another within the same department or attached to it for policy and program coordination.
c. International secondment – movement of an employee from one department to an international organization or body recognized by the Philippine government. (Guidelines on Secondment, CSC
