lito created the topic: double compensation
Good day!

This is the scenario: My wife is the current Barangay Nutrition Scholar in our barangay and at the same time employed in one of the national government agencies in our locality as Job Order. Is this case falls under double compensation? If indeed this is a violation of double compensation law, she has to relinquish one.

Thank you for the enlightenment.

Action Officer replied the topic: double compensation
Please be informed that as a matter of policy, the Commission refrains from rendering an opinion on matters that may be brought before it in the future by way of a complaint or an appeal.

As regards your query, your attention is invited Section 8 of Article IX (B) of the Constitution provides that “no elective or appointive public officer or employee shall receive additional, double, or indirect compensation, unless specifically authorized by law.” Clearly, unless authorized by law, it constitutes double compensation, which is prohibited under the Constitution.

We hope to have enlightened you on the matter.
