Please be informed that as a matter of policy, the Commission does not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is so especially when there are material facts necessary to the judicious adjudication of the issues which are not fully represented or substantiated as in this case.

Nevertheless, we wish to invite your attention to the following law and rules on personnel movement which may be relevant to your case, as follows:

1. Article 166 (Personnel Selection Board), Administrative Order No. 270 (IRR of the Local Government Code of 1991)

(a) There shall be established in every province, city or municipality a personnel selection board to assist the local chief executive or, where applicable, the presiding officer of the sanggunian, in the judicious and objective selection of personnel for employment as well as for promotion.

(b) The personnel selection board shall be composed of the local chief executive or his duly authorized representative as chairman, and members to be determined by resolution of the sanggunian concerned in accordance with pertinent civil service law, rules and regulations. A representative of CSC, if any, and the local human resource management officer or his equivalent in the LGU concerned, shall be ex officio members of the board.

2. Rule IX (Agency Merit Selection Plan and Human Resource Merit Promotion and Selection Board (HRMPSB)), 2017 Omnibus Rules on Appointment and Other Human Resource Actions

Sec. 84. Each agency may constitute two (2) Human Resource Merit Promotion and Selection Boards (HRMPSB)- one for the first and second level positions and another for second level executive/managerial positions.

An agency may establish special HRMPSB for specialized and highly technical positions or different sets of HRMPSB for its own purpose, but the same should be provided in the Agency Merit Selection Plan to be submitted to the CSC Regional Office concerned for approval.
