Hello Good day po sa inyo. Ako po ay isang nurse na nagtatrabaho sa pampublikong ospital. Noong January po ay pinagpasa kami ng five preferred dates namin para sa five days force leave. Kasama sa preferred dates na sinabi ko ay january 14 at february 18. Ito pong dalawang date na nabanggit ay hindi ko naman po naifile. Ngayon ay pinapawaive sa akin ng head nurse ko at ng tanungin ko kung pwede bang ilipat na lang sa ibang araw ang forced leave na hindi nagamit ay hindi na raw pwede dahil considered as forfeited na raw ito. Tama po ba ito? Ano po ang ruling ng Civil Service regarding dito

Please be informed that as a matter of policy, this Commission does not render opinion/ruling on issues that may eventually be a subject of a complaint or appeal before it.

Nevertheless, pertinent to your query is Section 25, Rule XVI, Omnibus Rules on Leave, which provides, as follows:

SECTION 25. Five days forced/mandatory leave. – All officials and employees with 10 days or more vacation leave credits shall be required to go on vacation leave whether continuous or intermittent for a minimum of five (5) working days annually under the following conditions:

“(a) The head of agency shall, upon prior consultation with the employees, prepare a staggered schedule of the mandatory five-day vacation leave of officials and employees, provided that he may, in the exigency of the service, cancel any previously scheduled leave.

“(b) The mandatory annual five-day vacation leave shall be forfeited if not taken during the year. However, in cases where the scheduled leave has been cancelled in the exigency of the service by the head of the agency, the scheduled leave not enjoyed shall no longer be deducted from the total accumulated vacation leave.
