Question Compensatory Time Off for 24/7 Operations Center Personnel

Good evening,

Respectfully may I ask for guidance re Availing Compensatory Time off for personnel working on a 24/7 Operations.

Initially, a team (3-12 members depending on the disaster) renders duty on a daily rotational 24/7 operations and are entitled to 1 day off the following day. Overmorrow, personnel will have to render duty again and avail a day off the following day. The same setup is practiced during weekdays, weekends, and even holidays - 1-day duty = 1 day off.

Recently, due to the pandemic and to minimize/contain the spread of COVID-19, the office adopted a weekly rotation of 2 teams. Personnel (3-12 team members) will render duty on a weekly 24/7 operations and avail a 1 week straight off. The weekly duty was unanimously acceptable to both teams.

Relative to this, may I inquire if these are acceptable to the CSC:
a. 1-day duty = 1 day off
b. straight 1-week duty = straight 1 week off
c. is the duty equate the availed off since, during weekends/holidays, the computation should be 1.5
d. since we are already on alert level 1, is it still allowed to render weekly duty, or is there an allowable number of straight duty days?
e. can we still allow WFH since there are team members who are PWD (with ID presented) and has health-related concerns (with doctors certificate).

Based on our experience, item d is more acceptable to us because we can focus more on the daily monitoring of advisories posted by warning agencies (PAGASA and PHIVOLCS) and preparation of disaster reports instead of having a daily turnover duty. Also, almost 1/3 of team members (from both teams) are living outside Metro Manila, and during daily turnover at 8:00 AM we finished around 11:00 AM. In addition, there are personnel who commute like me in going home (I usually reached home around 3:00 PM). Thus, the rest that was needed which is the purpose of a day off was not achieved.

Dear Jin:

Relevant to your query are the following provisions of CSC-DBM Joint Circular No. 2 series of 2004 (Non-Monetary Remuneration for Overtime Services Rendered), which provides, thus:

"5.5.1. Each employee may accrue not more than 40 hours of COCs in a month. In no instance shall, however, the unexpended balance shall exceed one hundred twenty (120) hours."

“5.5.2. The COC’s shall be used as time-off within the year these are earned until the immediately succeeding year. Thereafter, any unutilized COCs are deemed forfeited.” (as amended by CSC-DBM Joint Circular No. 2-A, series of 2005)

“5.9 Availment of CTO

“5.9.1 The CTO may be availed of in blocks of four (4) or eight (8) hours. Agencies adopting alternative work schedules should make parallel adjustments in the availment blocks, tantamount to either a half or full day leave from work.”

“5.9.2 The employee may use the CTO continuously up to a maximum of five (5) days per single availment, or on staggered basis within the year.”
