Ako po ay sumulat sa inyong tanggapan upang maliwanagan ang aking inaanak na kasalukuyang na nanunungkulan bilang Job Order sa isang ahensya ng gobyerno. Isa po sa kanyang tungkulin ay ang tumulong sa pag-compute at mag-monitor ng Daily Time Record at Leave Journal ng mga permanenteng empleyado. Sana po ay matulungan ninyo siya sa tamang pag-compute ng tardy/undertime ng mga kawani sa gobyerno. Halimbawa, kung ang official working hours nila ay ang sumusunod:

IN OUT
Monday 8:30 am 5:30 pm
Tuesday to Friday 9:00 am 6:00 pm

at ang isang empleyado ay pumasok ng sumusunod:

Monday 8:40 am 6:00 pm
Tuesday 10:30 am 6:10 pm
Wednesday 11:45 am 6:00 pm

ang naging computation ng aking inaanak para sa tardy ng naturang empleyado ay ganito:

Monday 10 minutes
Tuesday 1 hour 30 minutes
Wednesday 2 hours 45 minutes

ngunit ayon daw sa kanyang kasamahan sa trabaho ang computation ng tardy para sa araw ng wednesday ng naturang empleyado ay 4 hours dahil higit na po daw ito sa "1/4 or more" at pinagbasihan po nila na ruling ay ang third paragraph ng Sec. 28 Actual service defined ng OMNIBUS RULES ON LEAVE, RULE XVI of the Omnibus Rules Implementing Book V of Executive Order No. 292 na nagsasaad na A fraction of one-fourth or more but less than three-fourth shall be considered as one-half day and a fraction of three-fourths or more shall be counted as one full day for purposes of granting leave of absence. At dahil dito, maaari po bang makuha ang inyong opinyon upang maliwanagan at maituro kung ano ang tamang computation sa nailathalang halimbawa upang maituwid at maiayos ng tama ang pag-compute sa tardy/undertime ng empleyado. Maraming salamat.

Sections 5 and 6, Rule XVII (Government Office Hours), Omnibus Rules Implementing Book V of Executive Order No. 292 and Other Pertinent Civil Service Laws, provides:

SEC. 5. Officers and employees of all departments and agencies except those covered by special laws shall render not less than eight hours of work a day for five days a week or a total of forty hours a week, exclusive of time for lunch. As a general rule, such hours shall be from eight o' clock in the morning to twelve o' clock noon and from one o' clock to five o' clock in the afternoon on all days except Saturdays, Sundays and Holidays.

In addition, Section 6, Rule XVII of the Omnibus Rules Implementing Book V of E.O No. 292 and Other Pertinent Civil Service Laws provides that:

SEC. 6. Flexible working hours may be allowed subject to the discretion of the head of department or agency. In no case shall the weekly working hours be reduced in the event the department or agency adopts the flexi-time schedule in reporting for work.

Moreover, CSC Memorandum Circular No. 16, s. 2010 dated August 6, 2010 states that:

1. Any officer or employee who incurs undertime, regardless of the number of minutes/hours, ten (10) times a month for at least two months in a semester shall be liable for Simple Misconduct and/or Conduct Prejudicial to the Best Interest of the Service, as the case may be; and

2. Any officer or employee who incurs undertime, regardless of the number of minutes/hours, ten (10) times a month for at least two (2) consecutive months during the year shall be liable for Simple Misconduct and/or Conduct Prejudicial to the Best Interest of the Service, as the case may be.

In relation thereto, CSC MC No. 17, s. 2010 dated August 6, 2010 also provides:

1. Any officer or employee who is absent in the morning is considered to be tardy and is subject to the provisions on Habitual Tardiness; and

2. Any officer or employee who is absent in the afternoon is considered to have incurred undertime, subject to the provisions on Undertime.
