Good day! May I ask how many months does a (permanent) employee have to wait to apply for a promotion, is it 6 months or one year from his/her date of appointment? My follow-up question is, does this policy apply to both a newly hired employee and a former employee who has been promoted already before? Thank you

For appointment by promotion or transfer, the Performance Rating of the appointee in the last rating period prior to the date of assessment or screening, which should be at least Very Satisfactory, shall be required (2017 Revised ORA-OHRA).

The rating period will depend on the approved performance rating period of the agency. Likewise, the same is applicable with a newly hired employee.

Hi Clamie,

As a matter of policy, this Office refrains from rendering categorical opinion on matters and issues that may later on be the subject of an administrative proceeding before the Commission either via an appeal or a complaint. This is to preclude the possibility of prejudgment should an actual administrative case be commenced or instituted based on the said matters or issues.

Be that as it may, please be advised that Section 95 of the ORAOHRA, does not except or distinguish an employee who is under probation as provided in Section 14 of the ORAOHRA. Nevertheless, Section 95 (Par 1 and 2) provide, that:

Sec. 95. An employee should have obtained at least Very Satisfactory performance rating in the last rating period prior to the assessment or screening for promotion or transfer.

The performance rating of at least Very Satisfactory (VS) in the last rating period shall not be required for promotion from first to second level entry positions.

It is also advised to consult with the HR officer on your agency/office Merit Selection Plan which provides for the requisite performance rating for promotion and transfer.
