Hi, this is Mr. Erwin Abiad, Admin Officer, I would like to seek assistance on the proper implementation of the guidelines on parental leave to solo parents.

We have an employee who was given a solo parent ID and she wants to avail of the parental leave. She has a daughter who is unmarried, unemployed, still studying and turns 18 last 2018.

Is she allowed to avail of the parental leave as solo parent?

According to the Implementing Rules and Regulations of R.A. No. 8972 providing for benefits and privileges to solo parents and their children, “Children” – refer to those living with and dependent upon the solo parent for support who are unmarried, unemployed and below eighteen (18) years of age, or even eighteen (18) years and above but are incapable of self-support and/or mentally and/or physically challenged.
