Good Day! Clarify ko lang po sana, as per revised ORA OHRA under Rule IX, Section 95: "An employee should have obtained at least Very Satisfactory performance rating in the last rating period prior to the assessment or screening for promotion or transfer". Ang tanong po ay kung anong rating period ang i-consider kung ang case po ay JANUARY 2019 ang assessment or screening? (1st Sem) January-June 2018 po ba or (2nd Sem) July to December 2018? Consider po na sa SPMS Calendar, ang performance review po ng IPCR ay February 2019 pa po at hindi pa po nag convene ang PMT? Thank you po ang I hope to receive feedback from CSC. Thank you

Sir:

This refers to your query on the performance rating for the last rating period prior to the assessment or screening for promotion or transfer.

Please be informed that as a matter of policy, the Commission does not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is so especially when there are material facts necessary to the judicious adjudication of the issues which are not fully represented or substantiated as in this case.

Nonetheless, we wish to invite your attention to the following which may be relevant in your case:

1. Section 95 of the 2017 Omnibus Rules on Appointment and Other Human Resource Actions (ORA OHRA), which provides:

“Sec. 95. An employee should have obtained at least Very Satisfactory Performance Rating for one year in the present position before being considered for promotion.

“For agencies adopting semestral rating period, one (1) year is equivalent to two (2) performance ratings while for agencies adopting quarterly rating period, one year rating is equivalent to four (4) performance ratings.”

Ako po ay promoted noong AUGUST 2021, after 6 months or on FEBRUARY 2022 I tried to apply for promotion.
Based on Sec. 95, :last rating period" but it was not mentioned na dapat "last rating period for the current position", ang aming last rating period ay JULY - DECEMBER 2021, pero August lang ako na-promote.. invalidated po ba ako nun?
ang sabi maghintay ng rating period na 6 months sa current position which is JANUARY - JUNE 2022?

Dear Sir/ Madam,

I have been working as a Fishing Regulations Officer I under the Bureau of Fisheries and Aquatic Resource (BFAR) for almost three (3) months since September 01, 2023. The copy of my appointment is marked as CSC-approved also stating that my appointment is a “re-employment”. Before this recent appointment, I served 16.5 months in the same position from July 2015 until I resigned on November 15, 2016.

Below is my employment history:

a. Item Position: Fishing Regulations Officer I
Salary Grade: SG 11
Coverage Period: July 02, 2015 – November 15, 2016
Months Served: 16.5
Remarks: The resignation was tendered and position vacated effective November 16, 2016


b. Item Position: Fishing Regulations Officer I
Salary Grade: SG 11
Coverage Period: September 01, 2023 - present
Months Served: 2.75
Remarks: Marked as CSC-approved stating that my appointment is a case of “reemployment”; 3 months of government service this November 30, 2023

Tacking the period of my previous government service with my current service record indicates that I have already completed 19.25 months of government service and, thus, I respectfully submit that I have fulfilled all the requirements for promotion.

I planned to apply for promotion (SG 15), would these reasons be accepted and considered to entertain my application and qualify for promotion?
