Dear Sir/Madam:

I would like to seek clarification on how “terminal leave” should be applied when an employee voluntarily resigned from government service and requested for commutation of his leave credits but failed to report for work before the effectivity of his resignation.

The facts of the case are as follows:

Employee A, a regular employee of the Tribunal holding a plantilla position, recently filed his resignation on 01 June 2017. In his resignation letter, Employee A said that his resignation shall become effective at the end of business hours of 15 June 2017.

Employee A’s resignation was approved by the Chairperson of the Tribunal on 01 June 2017, subject to necessary clearances.

In his Application for Terminal Leave, Employee A still have 3.703 Vacation Leave Credits and 12.042 Sick Leave Credits or a total of 15.745 Leave Credits. Employee A likewise requested for commutation of said leave credits.

Unfortunately, Employee A failed to report for work on June 1, 2, 5, 6, 7, 8, 9, 13, 14 and 15, 2017 or for a total of ten (10) working days and did not file any leave during said period.

On 16 June 2017, Employee A was rehired by the Tribunal as consultant.

Question 1. Based on the above-mentioned set of facts, if Employee A has 15.745 leave credits and was absent for 10 days prior to the effectivity of his resignation, how should we treat and compute the ten (10) days of absences? Should it be computed as ordinary leave or terminal leave?

Question 2. How should we treat the remaining leave credits?

Question 3. Should our agency pay for the remaining leave credits? If yes, what rate should the agency use?
