Are LGUs covered by JC 01 S. 2017 of CSC, DBM, COA? LGUs are not specifically included in the Circular. If the said circular is applicable to LGUs, how should we reconcile with the provisions of Section 77 of LGC of 1991 which states that "the local chief executive may employ emergency or casual employees or laborers paid on a daily wage or piecework basis and hired through job orders for local projects authorized by the sanggunian concerned, without need of approval or attestation by the Civil Service Commission. Provided, further, That the period of employment of emergency or casual laborers as provided in this Section shall not exceed six months".

Please be informed that as a matter of policy, we do not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is especially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case. Nevertheless, this Office will state the applicable rule on the matter.

Nevertheless, it is an elementary rule of statutory construction that the express mention of one person, thing, act, or consequence excludes all others. This rule is expressed in the familiar maxim ‘expressio unius est exclusio alterius.’ Where a statute, by its terms, is expressly limited to certain matters, it may not, by interpretation or construction, be extended to others. The rule proceeds from the premise that the legislature would not have made specified enumerations in a statute had the intention been not to restrict its meaning and to confine its terms to those expressly mentioned.” (Centeno v. Villalon-Pornillos, G.R. No. 113092, September 1, 1994)
