Here at the Municipality of Carrascal, there was a post on the CSC - Tandag Office about the available item, Cooperative Development Specialist II, item No. 05. During my inquiry at the HR Office Ms. Jesselyn E. Lianza, AO IV/HRMO II of Carrascal stated that this item was already reserved for Ms. Christine Marie P. Arrenza which i have notice that she wasn't a passer or a holder of any CSC Eligibility.

Is that reservation of the item valid or legal?

Reservation of an item is not allowed, whether the applicant is qualified or not. The agency should publish the vacant position and accept application of all applicants thereto. However, once a ranking is made, the appointing authority may choose among the applicants recommended by the Personnel Selection Board (PSB) for appointment. If Lianza is not qualified due to lack of eligibility, then, the appointing authority may not validly appoint her thereto. Neither can she be appointed to the vacant position under temporary status if there are qualified eligibles who possess the necessary eligibility. Thanks.

Are there any possible legal action for those concerns ? Because as far as it is concern, according to the HRO she discourages me already and have stated that the item was already reserved.
