Good day,

I applied for a government position that was posted last September 2019 that expired last June 4, 2020. There was a dispute that took time for the PSB to settle and on the 23rd of June they were able to finalize everything only to find out it already expired. So they then decide to republish on the 26th of June. The CSC MC No. 14 that was promulgated on July 8, 2020 states that The nine (9)-month validity period of publication pursuant to Section 29
of the 2017 ORAOHRA, as amended, shall be extended for the period equivalent to the duration of the enhanced community quarantine (ECQ) or modified enhanced community quarantine (MECQ) imposed in the area where the agency is located, reckoned from the date of its lifting.
In this case the expiration of publication would have been on July 4. Since there was already a republication, will the CSC MC no. 14 still apply in my case and as of this writing?

Please be informed that as a matter of policy, this Commission does not render opinion/ruling on issues that may eventually be a subject of a complaint or appeal before it.

Nevertheless, Civil Service Commission Memorandum Circular (CSC MC) No. 14, s. 2020 provides as follows:

“1. Publication and Posting of Vacant Positions

“a. The nine (9)-month validity period of publication pursuant to Section 29 of the 2017 ORAOHRA, as amended, shall be extended for the period equivalent to the duration of the enhanced community quarantine (ECQ) or modified enhanced community quarantine (MECQ) imposed in the area where the agency is located, reckoned from the date of its lifting. The period covered by the ECQ/MECQ shall not be included in the counting of the nine-month validity period of publication. If the vacant position is not filled-up within the said extension, the agency has to cause its re-publication and posting pursuant to the said section.

“IV. Effectivity

“These interim guidelines shall take effect retroactively on March 16, 2020, the date of the President’s declaration placing the entire country under the State of Calamity and shall remain in force until the same has been lifted by the President of the Philippines”.(Emphasis supplied)
