Question Notice of Allocation Position

Facts:

Employee A has been appointed as Administrative Officer II. On 3 March 2006, employee A received a Notice of Position Allocation (For Individuals) which said, [sic] "Pursuant to Budget Circular No. 3. Series 2004 your position of Administrative Officer II has been allocated to Administrative Officer IV effective January 1, 2006.

This notice was signed by the Municipal Mayor.

Based on the QS, AO II is SG 15 while the AO IV is SG 22. Until now, Employee A's salary is based on the SG of AO II which is SG 15 and not SG 22.

Issue:
1. Is it proper that employee A's salary grade of 15 still be used as is, or shall the agency grant him the Salary Grade 22 in accordance with the CSC QS?
2. Given that A is granted the SG 22, is the agency oblige or liable to pay for A's salary from 2006 to the present?

Good Day!

Please be informed that as a matter of policy, the Commission does not right away direct an agency to pay any claims of salaries and other benefits which may be due an employee. Such directive to pay must emanate from a Commission decision issued on a proceeding which directly passes upon the subject matter.

As the matter of your concern is premised on Budget Circular No. 2004-3 dated March 6, 2004 issued by the Department of Budget and Management (DBM), please note that it is the DBM which issues guidelines on the allocation/reallocation/conversion of position/s, including the issuance of Notice of Organization, Staffing and Classification Action (NOSCA) reflecting the conversion of position/s, and Notice of Position Allocation to the employee/official concerned, and the DBM has the final say on the matter.
