Good day! May I ask what is really the nature of appointment if the appointee currently holds a Coterminous Position and will change into a Permanent Position of a higher salary grade.

Good day!

Please be informed that as a matter of policy, the Commission does not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is so especially when there are material facts necessary to the judicious adjudication of the issue which are not fully represented or substantiated as in this case.

However, relevant to your query are the following provisions of the 2017 Omnibus Rules on Appointment and Other Human Resource Actions (ORAOHRA), As Amended (2019 Edition):

Sections 7(a)(3) and (6), Rule III

3. Employment Status. The employment status shall be indicated on the space provided therefor. It may be permanent, temporary, coterminous, fixed term, contractual, substitute, or provisional. For contractual appointment, the duration of employment shall be indicated on the space provided for the Status of Appointment.

6. Nature of Appointment. The nature of appointment, which may be original, promotion, transfer, reemployment, reappointment, reinstatement, reclassification, or demotion, shall be indicated on the space provided therefor.


Section 11(e), Rule IV

e. Reappointment — the issuance of an appointment as a result of reorganization, devolution, salary standardization, re-nationalization, recategorization, rationalization or similar events, including the following:

1. The issuance of appointment from temporary to permanent, career to non-career or vice versa, non-career to another non-career, all of which entails no gap in the service, shall be considered as reappointment. Non-career employees who are appointed for the first time in the career service under permanent status shall be required to undergo probationary period for six (6) months.


Also relevant is Section 9 of Executive Order No. 292 which states:

Section 9. Non-Career Service. - The Non-Career Service shall be characterized by (1) entrance on bases other than those of the usual tests of merit and fitness utilized for the career service; and (2) tenure which is limited to a period specified by law, or which is coterminous with that of the appointing authority or subject to his pleasure, or which is limited to the duration of a particular project for which purpose employment was made.

Good day. There was a republication of a vacant position in January 7, 2022 to January 22, 2022 (Saturday). A reappointment issued to an applicant on January 24, 2022 (Monday). Is it valid? Thank you.

A vacant position was posted on Feb. 28, 2022 to March 15, 2022. Original appointment was issued to an applicant on the same date of March 15, 2022. Is it valid?
