Based on ORA OHRA, Section 97 item g:

"Other meritorious cases, such as :
- when the appointee is the lone applicant who meets all the requirements of the position and passed through the deep selection process
- when the qualified next-in-rank employees waived their right over the vacant position in writing
- when the next-in-rank position, as identified in the agency SRP is vacant
- when the next-in-rank employee/s is/are not qualified
- when the qualified next-in-rank employees did not apply"

Situation:
Vacant announced position: Corporate Executive Officer III, Level 1M
Next-in-rank based on SRP: Social Security Officer IV, Level 6NM (Vacant), Other Level 6NM position
Structure of the unit:
- Corporate Executive Officer III, L1M
- Social Security Officer IV, L6NM
- Claims Processor V, L5NM
- Claims Processor IV, L4NM
- Senior Clerk, L2NM

Applicants to the position:
- Claims Processor V, L5NM
- Claims Processor IV, L4NM
- Claims Processor III, L3NM

All applicants are qualified based on the Qualification Standards of the position.

Questions:
The next-in-rank to the position is vacant and no other Level 6NM applied to the position.
- Can we consider all the applicants for the position, regardless of level?
- Based on the situation, can we only consider, Level 5NM, since this level is next to the next-in-rank to the vacant position?

Please be informed that as a policy, the Commission does not render opinions/rulings on issues that may eventually be the subject of a complaint or appeal before it. This is especially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case. Nevertheless, we will cite the pertinent provision/s under the Civil Service rules and applicable jurisprudence that will best answer your query/ies.

An employee may be promoted to a position which is not more than three (3) salary grade, pay or job grades higher than the employee’s present position. All appointments issued in violation of this policy shall be disapproved/invalidated, except when the promotional appointment falls under the purview of the following exceptions . . . (Sec. 97, Rule IX, 2017 ORAOHRA (Revised July 2018)

The candidates passed through a deep selection process, taking into consideration the candidates’ superior qualifications in regard to: Educational achievements, Highly specialized trainings, Relevant work experience or Consistent high performance rating/ranking. (Sec. 97 (e), Rule IX, 2017 ORAOHRA (Revised July 2018)
