Good day sir madam:

I hope this email finds you well. I was promoted as Teacher II dated March 22, 2021 as signed by our Schools Division Superintendent. My attested appointment for the said promotion was not yet released by the CSC because there are some documents that I need to comply due to my change of name (because of marriage). The school where I had been teaching for 7 years announces for an open ranking for Teacher III vacancy. I would like to ask if I am qualified for the said position? Is there a law that says that a person aspiring for promotion should at least be 1 year in his/her current position/designation?

Good day, Sir/Maam!

Please be informed that as a policy, the Commission does not render opinions/rulings on issues that may eventually be the subject of a complaint or appeal before it. This is especially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case. Nevertheless, we will cite the pertinent provision/s under the Civil Service rules and applicable jurisprudence that will best answer your query/ies.

Section 95, Rule IX, 2017 Omnibus Rules on Appointments and Other Human Resource Actions (Revised July 2018) (CSC Resolution No. 1800692 dated July 3, 2018 as circularized in CSC Memorandum Circular No. 14, s. 2018 dated August 30, 2018), specifically provides: “Sec. 95. An employee should have obtained at least Very Satisfactory performance rating in the last rating period prior to the assessment or screening for promotion or transfer.”

Finally, you are advised to seek guidance from the Human Resource Management Officer (HRMO) of the agency where you are applying for appointment.
