I would like to ask if an Administrative Assistant II (SG 08), a Non-Teaching Position can be promoted to a New Teaching Positions created in the Senior High School like SHS Teacher III (SG 13) or Special Science Teacher I (SG 13) even there is what we call quantum leap rule?

the Applicant has the following qualifications,

Education: Bachelor Science in Business Administration with 36 units Master of Business Administration
Experience: 1 year as Administrative Assistant II and 2 years as Administrative Aide III
Training: 40 hours
Eligibility: RA 1080 (Teacher), Career Service Professional, Penology Officer

The Qualification of SHS Teacher III is stated below:
Teacher III (Senior  High School)  [SG 13] 
Education: Bachelor’s degree majoring in the relevant  strand/ subject; or any Bachelor’s degree plus  at least 12 units towards a Master’s degree in  relevant strand/ subject 
Experience: 1 year of relevant   teaching/industry work  experience 
Training: 4 hours of training relevant  to the subject area
Eligibility: RA 1080 (Teacher)

And the Qualification of Special Science Teacher I is also stated below:
Education: Bachelor's Degree in Education or its equivalent with a major and minor or Bachelor's degree in arts and sciences with at least 10 units in professional education
Experience: None Required
Training: None Required
Eligibility: RA 1080 (Teacher), None Required (those covered by RA 3661)

Please note that as a matter of policy, the CSC-Office for Legal Affairs (OLA) refrains from rendering categorical opinion on matters and issues that may later on be the subject of an administrative proceeding before the Commission either via an appeal or a complaint. This is to preclude the possibility of prejudgment should an actual administrative case be commenced or instituted based on the said matters or issues.

Be that as it may, if the applicant possess the required QS for the position applied for, he/she may be appointed to that position, subject to civil service rules on appointment.

As to the applicability of the three-salary grade rule, Section 97, Rule IX, 2017 Omnibus Rules on Appointments and Other Human Resource Actions (2017 ORAOHRA) provides:

Sec. 97. An employee may be promoted to a position which is not more than three (3) salary grade, pay or job grades higher than the employee’s present position. All appointments issued in violation of this policy shall be disapproved/invalidated, except when the promotional appointment falls within the purview of any of the following exceptions:

a. The position occupied by the person is next-in-rank to the vacant position as identified in the Merit Selection Plan and the System of Ranking Positions (SRP) of the agency.

b. The vacant position is a lone or entrance position, as indicated in the agency staffing pattern.

c. The vacant position is hard to fill, such as Accountant, Medical Officer/Specialist, Attorney, or Information Technology Officer/Computer Programmer positions.

d. The vacant position is unique and/or highly specialized, such as Actuarial, Airways Communicator positions.

e. The candidates passed through a deep selection process, taking into consideration the candidates’ superior qualifications in regard to:

• Educational achievements
• Highly specialized trainings
• Relevant work experience
• Consistent high performance rating/ranking

f. The vacant position belongs to the closed career system, i.e., those that are scientific, or highly technical in nature that include the faculty and academic staff of state colleges and universities, and the scientific and technical positions in scientific or research institutions, all of which establish and maintain their own merit systems.

g. Other meritorious cases, such as:

• when the appointee is the lone applicant who meets all the requirements of the position and passed through the deep selection process

• when the qualified next-in-rank employees waived their right over the vacant position in writing

• when the next-in-rank position, as identified in the agency SRP is vacant

• when the next-in-rank employee/s is/are not qualified

• when the qualified next-in-rank employees did not apply

Hi I just wanted to ask if pwede bang mag pa rank ang isang government employee sa 2 different positions? If so may basis ba tayo na dpat iwaive nya ung existing ranking nya?

Hi Glaiza,

At the moment, there is no prohibition for applying for two or more positions within an office or agency. Nevertheless, it is advised to consult with the HR Officer of your agency/office as regards to the requirements and processes for promotion as provided in the agency/office Merit Selection Plan.
