Good day.

Is it possible for the budget officer & accountant to refuse in signing documents attached to an appointment already approved by the appointing authority in the LGU? (Reason: the budget officer will only sign if the accountant will sign first, while the accountant will also sign if the budget officer will sign first). Need clarification.

Your query is vague. Nevertheless, for your information only the Commission can approved an appointment, through its field offices.

Moreover, Under Rule IV, Section 1 of Civil Service Commission Memorandum Circular No. 40-98, an appointment takes effect immediately upon issuance by the appointing authority. Once the appointee has assumed the duties of the position, he or she is entitled to receive the salaries corresponding with the position though the Civil Service Commission has not yet approved the appointment. In addition, upon submission and examination of your appointment and its attached documents to the Civil Service Commission Field Office (CSC FO) concerned, the FO will require your agency to complete the requirements, which may include the document to be signed by the accountant and budget officer. In the end, they cannot refuse to sign said document.

Section 1, Rule IV of the Revised Omnibus Rules on Appointments and Other Personnel Actions provides that ---An appointment issued in accordance with pertinent laws and rules shall take effect immediately upon its issuance by the appointing authority and if the appointee has assumed the duties of the position, he shall be entitled to receive his salary at once without awaiting the approval of his appointment by the Commission. The appointment shall remain effective until disapproved by the Commission. In no case shall an appointment take effect earlier than the date of its issuance.

Clearly, an appointment takes effect immediately upon its issuance by the appointing authority. In addition, if the appointee has assumed the duties of the position, he/she is entitled to receive the salary and benefits without awaiting the approval of his/her appointment by the Commission and the appointment shall remain effective until disapproved by the Commission.
