Dear Sir/Madam:

Greetings.

In response to your query "Can a casual employee run for an elective position (i.e Barangay Kagawad)? Are they covered by the prohibition against government employees?", may we invite your attention to Sections 117 to 119, Rule 12, of the 2017 Omnibus Rules on Appointments and Other Human Resource Actions (Revised July 2018). Said provisions state as follows:

"RULE XII
PROHIBITIONS

“Section. 117. No appointive official shall hold any other office or employment in the government unless otherwise allowed by law or by the primary functions of his/her position.

“Section. 118. No elective official shall be eligible for appointment in any capacity to any public office or position during his/her tenure.

“Section. 119.No elective or appointive public officer or employee shall receive additional, double or indirect compensation, unless specifically authorized by law, nor accept without the consent of Congress, any present, emolument, office or title of any kind from any foreign government.

Pensions and gratuities shall not be considered as additional, double or indirect compensation."

Based on the foregoing, an employee of the government may run for barangay elections, but he/she must severe his appointive position in case he/she becomes elected. The reason being, the rules prohibit double compensation and holding of another employment in the government for appointive and elective official (during his/her tenure).
