good day!
mag inquire lng po aq regarding promotion or appointment.. last nov 2016, nadeliberate po ako to become Nurse 2, awaiting nlng po to sign the appointment from CSC.. pero, last march 2017 nabuntis po ako at nirequire po ng doctor for bed rest kasi maselan po..ngstart ang leave ko march 6,2017.. ung appointment paper ko po ay napirmahan ng hospital director ng march 9, 2017.. ang sabi po s akin ng personnel, pipirma po aq pagbalik ko s work kasi napirmahan n po ng medical director namin ung appointment paper q..ngleave po ako the entire pregnancy until 2 months maternity leave, bale 11 months in total..nung bumalik po aq s work dec 25,2017, ang sabi po s akin s personnel, nacancel daw po ang promotion ko dhil hndi daw po ako pumapasok at ang tagal daw po ng ni-leave ko.. question ko po ay, may habol pa po b ako dun s previous n appointment q? kasi ngpromote po sila ulit last week, hndi po ako mkasama, dhil s same reason na ang tagal q daw po nawala.. hndi ko po ba pwede magamit ang mga requirements q last 2016 para po matuloy ang promotion ko? gaano po katagal ang validity ng mga requirements at ng appointment bago po maforfeit?

with regards to the term "official leave of absence", can i have a definition of it according to CSC guidelines? is unpaid maternity leave for 9 months included? granting that it was supported by medical documents? lastly, where or who can I personally seek advice or ask for backup documents/rules which I hope i can use to prove my claim (just in case) regarding this matter? ..thank you very much..

Dear Ms. Hermoso:

Please be informed that it is the policy of the Civil Service Commission not to render opinions or rulings on issues that may eventually be a subject of a controversy or complaint before it. This is specially so if the material facts necessary to arrive at an objective analysis of the case are incompletely presented.

Be that as it may, to guide you in your next course of action, may we call your attention to Sections 53 and 54 of the Omnibus Rules on Leave, which provide, thus:

"Sec. 53. Application for sick leave. — All applications for sick leave of absence for one full day or more shall be made on the prescribed form and shall be filed immediately upon employee’s return from such leave. Notice of absence, however, should be sent to the immediate supervisor and/or to the agency head. Application for sick leave in excess of five (5) successive days shall be accompanied by a proper medical certificate.

"Sick leave may be applied for in advance in cases where the official or employee will undergo medical examination or operation or advised to rest in view of ill health duly supported by a medical certificate.

"In ordinary application for sick leave already taken not exceeding five days, the head of department or agency concerned may duly determine whether or not granting of sick leave is proper under the circumstances. In case of doubt, a medical certificate may be required.

"Sec. 54. Approval of sick leave. — Sick leave shall be granted only on account of sickness or disability on the part of the employee concerned or of any member of his immediate family.

"Approval of sick leave, whether with pay or without pay, is mandatory provided proof of sickness or disability is attached to the application in accordance with the requirements prescribed under the preceding section. Unreasonable delay in the approval thereof or non-approval without justifiable reason shall be a ground for appropriate sanction against the official concerned."

Based on the foregoing, an employee on sick leave is considered on official leave if he/she has secured the necessary approval of the department/agency head.

With regard your concern as to the period of validity of the requirements you submitted from your previous application for promotion, you may refer to your agency's Merit Promotion Plan for guidance.
