Hello, would like to ask if pwede bang mainvalidate and appointment if may namiss na procedure sa screening process e.g. written exam? But from publication up to the PSB deliberation and appointment processing are in order. What is the remedy if may naappoint na and nag assume na sa position pero hindi nabigyan ng written exam?

Good day!

Yes, it can be invalidated/disapproved, provided the written examination is part of and required in the agency’s Merit Selection Plan (MSP), which was approved by the Civil Service Commission Regional Office (CSC RO), then, non-compliance therewith will be a ground for the disapproval/invalidation of an appointment.

Relevantly, Sections 102 and 103, Rule IX, 2017 Omnibus Rules on Appointments and Other Human Resource Actions (Revised July 2018) provide, as follows:

Section 102. All government agencies shall submit their Agency MSP to the CSC RO concerned, which shall take effect immediately upon approval. All subsequent amendments shall take effect immediately upon approval by the CSC RO concerned.

Section 103. The Agency MSP signed by the head of the agency shall be considered as a valid contract binding among the head of agency, the employees and the CSC. As such, non-compliance by the agency with the policies and procedures provided therein shall be considered as a ground for disapproval/invalidation of appointment. The same be a ground for administrative disciplinary action against the official or employee who caused the violation.
