hi,
im a temporary appointed local accountant since no available CPA in our locality that fit tbe job, im temporary appointed for 1 year and renewed for 4 times already with XYZ note that to be replaced once CPA is AVAILABLE last year i renewed since no CPA in our locality "as per local code requirement that municipal accountant must be a resident of the locality, certified by punong brgy"-- to my shock, i was disapproved because of RA 1080, municipal accountant is a mandatory position as per local code. my question is, DOES THE DISAPPROVED OF MY APPOINTMENT VALID?

p.s. our LCE certified that no available eligible applying in our locality. im not a CPA but im a BS accountancy graduate with 1st grade eligibility.

Please be informed that as a matter of policy, the Commission does not render opinions or rulings on issues that may be the subject of a complaint or appeal before it. This is so especially when there are material facts necessary to the judicious adjudication of the issues which are not fully represented or substantiated as in this case.

Nonetheless, please be informed that under Section 474 of R.A. No. 7160 (The Local Government Code of 1991), the following are the qualifications of an Accountant:

Section 474. Qualifications

(a) No person shall be appointed accountant unless he is a citizen of the Philippines, a resident of the local government unit concerned, of good moral character, and a certified public accountant. He must have acquired experience in the treasury or accounting service for at least five (5) years in the case of the provincial or city accountant, and three (3) years in the case of the municipal accountant.

Section 26, R.A No. 9298 (The Philippine Accountancy Act of 2004), provides the prohibition in the practice of accountancy. Please take note that eligibilities resulting from passing the bar/board examinations shall be required for appointment to positions the duties of which constitute the practice of profession regulated by the Philippine BAR/Board laws.

Considering that the duties and functions of a Municipal Accountant involves the practice of accountancy defined under R.A. No. 9298, the necessary CPA eligibility (R.A. No. 1080) is an indispensable requirement for appointment to said position.
