Good am. A govt employee has been designated to a position since 2008 until now. However, when the said employee requested to fill up the vacant position, the psb deferred the request for further study
Question 1. What can the employee do? She wad doing the work deligently without increase in salary hence deprived of monetary benefits of the designatef position.

Please be informed that the Commission already issued guidelines on Designation through CSC Resolution No. 05-0157 dated February 7, 2005, circularized in CSC MC No. 6, s. 2005 dated February 15, 2005, to wit:

“A. Employees to be designated should hold permanent appointments to career positions.

“B. Designees can only be designated to positions within the level they are currently occupying. However, Division Chiefs may be designated to perform the duties of third level positions.

First level personnel cannot be designated to perform the duties of second level positions.

“C. For positions with incumbents who temporarily cannot perform the duties of the position (vacation or sick leave, study leave, scholarship, maternity leave, special assignments), the designation should be synchronized with the absence of the incumbent provided that in no case shall a designation exceed one (1) year.

“D. For positions without incumbents, a designation may be made only for a maximum of one (1) year.

“E. Designation shall be made through an office order issued by the Head of Agency or the Head of Office concerned.

“F. Designee cannot be granted the salaries of the positions they are being designated to, except allowances that go with the performance of the functions such as RATA.”

What if the position only has PERA and not RATA, can an employee designated to another position claims the PERA?

No. It is very clear that "Designee cannot be granted the salaries of the positions they are being designated to". If the employee is already receiving PERA, he or she cannot accept another PERA.

Hi po!
2 years ago an Assistant Municipal treasurer from other town but within the same Province was designated as the OIC Municipal Treasurer in our LGU. She receives the salary of an Assistant Treasurer and receives RATA.
Her designation lasted for 1 year 5 months and 12 days to be exact. since we keep on requesting for extension of her service until we received her Appointment as the Municipal Treasurer a year ago. Upon her order from BLGF, the municipality where she came from right away closes her records, removed her from their payroll and noted "transferred" in her service record.
now, She seeks to claim the leave credits accumulated (1yr 5mth 12 days) when she was still designated as OIC-MT.
Her claim was denied since shes only a designated OIC-MT. Her service record in our LGU started only when she was appointed MT. so there is a gap which the CSC does not allow according sa HR namin.
Question: is there any chances she can avail the leave credits(1yr 5mth 12 days)? sayang naman po kasi dahil pinaghirapan din nya yon. malapit na syang mag retire at nais ng LCE namin na pagbigyan sya, subalit kung labag naman sa batas d rin maari.
