Good Day! I would like to ask something about the implementation of the topic, particularly on Item 6.2 of CSC-DBM Joint Circular No. 1 Series of 2012, dated September 3, 2012, which states:

6.2 Length of service in the present position shall also include the period rendered by an incumbent prior to his/her transfer within the same agency or to another agency in a position with the same or comparable position and salary grade.

I am an employee from a NGA for almost 23 years now. I was appointed as Chief LEO (SG 24) in our Regional Office on January 2010 and I transferred to our Central Office on January 2011 as Internal Auditor V (SG 24). Both positions are performing Division Chief functions and responsibilities.

On January 2013 I was granted 2nd Step Increment due to length of service and on January 2016 the 3rd Step was granted also by our Human Resource Development Service (HRDS). To my surprise when I followed up my 4th Step Increment for January 2019, the personnel handling the processing of Step Increment said that I was not yet entitled because my 2nd and 3rd Step Increments were granted a year advance.

From the guidelines set by CSC-DBM Joint Circular No. 1 Series of 2012, it was clearly stated that my services rendered in 2010-2011 shall be included, and this is the very basis why they grant my 2nd and 3rd Step Increments.

In this regard, is my interpretation of law correct for my situation? Is there any law that says I am not entitled yet (maybe there is an updated law)? What action can I pursue if they failed to grant my step increment?

Good day!

Please be informed that as a matter of policy, the Commission does not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is so especially when there are material facts necessary to the judicious adjudication of the issue which are not fully represented or substantiated as in this case.

However, we call your attention to CSC DBM Joint Circular No. 1, s. 2012, which partially reads:

6.0 Grant of Step Increment Due to Length of Service
6.1. One (1) Step Increment Due to Length of Service shall be granted to qualified personnel for every three (3) years of continuous satisfactory service in the present position. x x
6.2. Length of service in the present position shall also include the period rendered by an incumbent prior to his/her transfer within the same agency or to another agency in a position with the same or comparable position and salary grade.

Based on your representation, the position Chief LEO and Internal Auditor are comparable positions and have the same salary grade. In that case, the initial grant for the 2nd and 3rd step increment are correct.

As to your query on what your action may be if they failed to grant you your step increment, we call your attention to the following provision under the same Joint MC, to wit:

13.0. Complaints and protests arising from the implementation of this Joint Circular shall be governed by CSC Memorandum Circular No. 2, s. 2001, "Revised Policies on the Settlement of Grievances in the Public Sector."
