Question Clarification on the interpretation of Sec. 95 of the revised ORAOHRA

I was promoted from Administrative Officer II to Administrative Officer III on July 2021, using my performance rating for the semester ending December 2020 as Administrative Officer II.

Am I allowed to apply again for promotion to Administrative Officer IV position, opening of which was announced by my agency on September 2021:

1. Despite I am only 2 months from my present position of Administrative Officer III?
2. Using my performance rating for the semester ending June 2021 as Administrative Officer II?

Sec. 95 of the ORAOHRA, as revised, did not qualify any length of service in the current position before applying again for promotion or that the rating to be used is that of the present position, but only states that "an employee should have obtained at least Very Satisfactory performance rating in the last rating period prior to the assessment or screening for promotion or transfer."

Please clarify. Thank you.

Hi Jane Doe,

As a matter of policy, this Office refrains from rendering categorical opinion on matters and issues that may later on be the subject of an administrative proceeding before the Commission either via an appeal or a complaint. This is to preclude the possibility of prejudgment should an actual administrative case be commenced or instituted based on the said matters or issues.

Be that as it may, as you have stated, Section 95 (1st Pararaph), Rule IX, 2017 ORAOHRA merely provide, that an employee should have obtained at least Very Satisfactory performance rating in the last rating period prior to the assessment or screening for promotion or transfer.

Nevertheless, it is advised to seek clarification from the Human Resource Policies and Standards Office (HRPSO) of the CSC as to the extent or limitations, if any, of the avbovecited rule, considering that rules on appointment and other human resource actions are within its jurisdiction and expertise.
