Hello,

I would like to ask if a Plantilla Item with a personnel can be transferred to another office and outside the current geographic area without informing the concerned personnel by virtue of the DBM approved Personnel Services Itemization and Plantilla of Personnel? Thus the scenario of recalling even if not reassigned in the past.

Good day!

Please be informed that as a matter of policy, the Commission does not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is so especially when there are material facts necessary to the judicious adjudication of the issue which are not fully represented or substantiated as in this case

However, we call your attention to the provisions of Republic Act No. 6656 (An Act to Protect the Security of Tenure of Civil Service Officers and Employees in the Implementation of Government Reorganization) and Executive Order No. 366,s. 2004 (Directing a Strategy Review of the Operations and Organizations of the Executive Branch and Providing Options and Incentives for Government Employees who May be Affected by the Rationalization of the Functions and Agencies of the Executive Branch). The mentioned laws provide the rules for the reorganization in the government. The reorganization of a government agency entails the issuance of a new Personnel Services Itemization and Plantilla of Personnel as approved by the Department of Budget and Management (DBM).
