Dear CSC,

Nagapply po ako sa isang plantilla position (SG 18) sa government. Gusto ko pong malaman kung paano po ang process sa pag submit ng appeal or protest sa hiring result ng application. Hindi napo kasi ipinapina-alam sa aming applicants ang basis ng hiring at sa palagay ko po, hindi ako ang nakuha dahil galing ako sa isang minority group.

Ano po ang pwede kong gawin or action tungkol dito?

Good day, Maam.

Please be informed that as a policy, the Commission does not render opinions/rulings on issues that may eventually be the subject of a complaint or appeal before it. This is especially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case. Nevertheless, we will cite the pertinent provision/s under the Civil Service rules and applicable jurisprudence that will best answer your query/ies.

Section 99, Rule 18 of the 2017 Rules on Administrative Cases in the Civil Service (CSC Resolution No. 1701077 dated July 3, 2017), specifically provides: “Section 99. Recall of Approval/Validation of Appointment; Who may file. The Commission, or any of its CSC RO or CSC RO, motu proprio or upon petition by any person, may initiate the recall of approval/validation of an appointment of an official or employee who does not meet the requisite qualification standards of the position or on the ground that the appointment was issued in violation of existing civil service laws, rules, and regulations.”
