good day! i would like to inquire if in case the invalidation of appointment was upheld, what will happen to the appointee if her previous position has been filled up? what will happen to the person who was appointed to that previous position of the "invalidated"? and to the person who was promoted thereafter? thank you..

Section 155 of the Revised Rules on Administrative Cases in the Civil Service provides that: "In case of disapproval, invalidation, recall and revocation of appointments, the appointee shall be restored to his/her former position without loss of seniority rights."

Good day, Sir!

Based on "Section 155 of the Revised Rules on Administrative Cases in the Civil Service provides that: "In case of disapproval, invalidation, recall and revocation of appointments, the appointee shall be restored to his/her former position without loss of seniority rights.", what will happen to the invalidated appointee if the former position has already been occupied by another personnel, who is validated by CSC based on QS? And the available position for the invalidated appointee is lower than his/her former position?

I hope we can have a clarity on this. Thanks!

Section 155 of the Revised Rules on Administrative Cases in the Civil Service (CSC Resolution No. 1101502 dated November 8, 2011) provides that: "In case of disapproval, invalidation, recall and revocation of appointments, the appointee shall be restored to his/her former position without loss of seniority rights." This provision means that the appointee, whose promotional appointment was disapproved, invalidated, recalled or revoked by the Commission, shall be restored to his/her former position prior to promotion. Naturally, the incumbent of his/her previous position shall give way to the former holder thereof.
