Question Leave Without Pay

Good morning.

Can an employee who was just granted and availed the maximum 1 year leave without pay then who is now reporting back to work the past 4 months, re-avail of another 1 year leave without pay? is there a prescribed period in-between such LWOPs? or is there a required length of service before an employee can re-avail the LWOP?

Action Officer 10 replied the topic: Leave Without Pay
Based on Section 57 of the Omnibus Rules on Leave, "Leave without pay not exceeding one year may be granted, in addition to the vacation and/or sick leave earned. Leave without pay in excess of one month shall require the clearance of the proper head of department or agency." Furthermore, Section 58 thereof also states, "Leave without pay shall not be granted whenever an employee has leave with pay to his credit except in the case of secondment." The rules, however, do not provide for any limitation on the frequency that such application may be filed and granted.
