Hello CSC: From MC No.06 s.1996, it is stated in par.3 that: "xxx...employee shall seek approval of the application for the said special leave privileges for at least one (1) week prior to the availment of the special leave privilege, except on emergency cases."

My question falls on these "emergency cases" - when should the employee file his/her emergency leave application, given that he/she already took said leave?

Section 21 of the Omnibus Rules on Leave (Rule XVI of the Omnibus Rules Implementing Book V of Executive Order (E.O) No. 292 provides, as follows:

Sec. 21. Special leave privileges. In addition to the vacation, sick, maternity and paternity leave, officials and employees with or without existing or approved Collective Negotiation Agreement (CNA), except teachers and those covered by special leave laws, are granted the following special leave privileges subject to the conditions hereunder stated:

c.) Filial obligations to cover the employee's moral obligation toward his parents and siblings for their medical and social needs;
d.) Domestic emergencies such as sudden urgent repairs needed at home, sudden absence of yaya or maid, and the like

f.) Calamity, accident, hospitalization leave pertain to force majeure events that affect the life, limb, and property of the employee or his immediate family.

2. Employees applying for special privilege leaves shall no long be required to present proof that they are entitled to avail of such leaves.

With regard to your query, you may file your emergency leave application even after the day you availed of such leave and you are not required to present proof that you are entitled of such leave.

When you indicated after the day availed, I understand this to refer to a situation when the employee reports the day after he/she availed of his/her emergency leave. In such a case, will the employee's leave application be disapproved if he/she fails to file his/her application on the day he/she reported?

In another scenario, what if the employee still has not reported the day after he/she availed of his/her emergency leave - can he/she avail of another emergency leave (which does not require proof, as you indicated; and, more importantly, can be filed after leave availment)? OR will the next (absent) day be considered a VL or SPL (whichever is applicable), which, by virtue of precedent circumstances, failed to meet the required 1-week advance filing before availment - how is this reconciled in employee leave monitoring?
