I would like to inquire regarding the availment of quarantine leave. Our HR required me to undergo 14-day quarantine (July 30-Aug 13) due to possible exposure to one of my colleagues who was tested positive for COVID19. On the 13th day (August 11) of my quarantine period, I started manifesting flu-like symptoms (fever and chills), which lasted for two days. On August 15, I noticed that I lose my sense of smell, so I continue my quarantine. On August 19, I tried securing an RT-PCR test as a requirement so I could return to work and also have peace of mind. However, the result turned out that I am positive for COVID19 and need to undergo isolation for another 14 days.

Is the 14 day isolation period will be deducted from my leave credits, considering that I underwent the mandatory 14-day quarantine prior I was tested positive for COVID19?

Dear Sir/Madam:

This pertains to your letter inquiring whether your 14 day isolation/quarantine period would be deducted from my leave credits, considering that you underwent the mandatory 14-day quarantine prior to your being tested positive for COVID19.

May we inform you that as a matter of policy, the Commission does not render opinions or rulings on issues that may eventually be the subject of a complaint or appeal before it. This is specially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case. Nevertheless, this Office will state the applicable rules regulations on the circumstances.

Please be directed that to date the rules pertaining to mechanisms for workers in the government during the period of public health emergency due to Covid-19 pandemic is found Civil Service Commission Memorandum Circular (CSC MC) No. 8, series of 2020 (Revised Interim Guidelines for Alternative Work Arrangement). At present, however, there is a proposed amendment on said policy to cover every instance of quarantine and/or treatment applicable to all government employees. In the meantime, while said amendment is not yet approved, CSC MC No. 8, series of 2020 shall apply. Nevertheless, in case the amendment to CSC MC No. 8, s. 2020 shall be approved, said amendment may have retroactive effect, and it is possible that the deducted leave credits would be restored.

The CSC MC No. 8, s. 2020 may easily be accessed in the CSC Website ( www.csc.gov.ph ), just click on the issuance section of said page and look for the 2020 folder to locate the said CSC MC.

Please be guided accordingly.
