Sir/Madam:

Grant of Parental Leave of Solo Parents as per MC 8 s. 2004. It stated that the application for parental leave shall be submitted at least 1 week prior to its availment, except on emergency cases.

My scenario is my child is attending online classes accompanied by his tutor everyday. The tutor got sick and texted me that she will be absent and not be able to accompany my child to his online class (that day was also his examination day). Can i file for a parental leave as emergency case? thank you.

Good day Maam.

Please be informed that as a policy, the Commission does not render opinions/rulings on issues that may eventually be the subject of a complaint or appeal before it. This is especially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case.

Nevertheless, we will cite the pertinent provisions under the Civil Service rules and applicable jurisprudence that will best answer your queries.

Memorandum Circular (MC) No. 08, s. 2004 provides, as follows:

“3. Parental leave- shall refer to leave benefits granted to a solo parent to enable said parent to perform parental duties and responsibilities where physical presence is required.

“IV. CONDITIONS FOR AVAILING A PARENTAL LEAVE

“The parental leave of seven (7) days in addition to existing leave privileges shall be granted to any solo parent employee subject to the following conditions:

“3. The parental leave shall be availed of on a staggered or continuous basis subject to the approval of head of agency/office. In this regard, the solo parent shall submit the application for parental leave at least one (1) week prior to its availment, except on emergency cases.

As regards the circumstances in which a solo parent may avail of parental leave, may we refer you to Item IV (4) of MC No. 08, s. 2004.
