May I request clarification on prohibition to be promoted within 6 months prior to compulsory retirement? Does this mean if you started in the agency but has not served there for atleast 6 months, you can’t be promoted even if you meet the qualifications?

Dear Michelle:

The prohibition means that no promotion shall be issued to a government official/employee who will be reaching the compulsory retirement age within 6 months, except as otherwise provided by law.

Am I qualified for promotion if there is any vacant Master Teacher I/II for SHS in our Division?

I am a Senior. High School (SHS) teacher with a Teaching Rank of Teacher III (Permanent) for almost 2 years. My qualifications are as follows:

1. Education: AB POLSCI and MAEd-INM (Graduated) Juris Doctor (at present)

2. Experience: 6 years teaching experience

3. Training : exceeded required training hours

4. Eligibility: CSC-Prof and LET

5. Performance Rating: VS (2016-2017) NB: PR for 2017-2018 (on process)

Last week, Our Division announced the Hiring of SHS Teachers SY 2018-2019. And, I am thinking to file an application for my promotion maybe as MT1 or MTII (if there is vacancy). However, my dilemma is, some officers and teachers are saying that “no promotion for SHS Teachers; at least three (3) years in the service with performance rating of Very Satisfactory and there is no guidelines for reclassification,” because of it, I read Omnibus Rules on Appointment and Other HR Action 2017. Subsequently, I found out that promotion and reclassification are different in its strict sense. Further, the 3-year rule of PR was already rescinded by said Omnibus Rules. Now my questions are as follows, to wit:

1. Are my understanding of the new omnibus rules are correct in connection with my queries?

2. Am I qualified for promotion?

3. Can I apply for a promotion?

Please answers my questions as soon as possible because the deadline for application is Feb. 19-21, 2018.
