Hello. Is Dislocation Pay still in effect?

A Division Chief has been reassigned last 9 July 2018 from her station in Silang, Cavite, to their national office in Quezon City despite having no due basis, written or otherwise. She very well knows that it was a form of constructive dismissal but she quietly accepted the transfer to not cause herself more stress and heartache (you know how office politics go and how vindictive people can get once you start creating "noise"). She had to rent an apartment with a one year contract, legally binding, in QC. She also bought appliances and obtained other collaterals as a consequence of the transfer.

However, she was reassigned back to her former station after three months (effective 15 October 2018). On 18 October, she requested for reconsideration to be retained in her present post stating financial burden but on that same day she received a memo from their HR that her request has been repudiated. Currently, she is back in Silang, Cavite, but she still pays for the remainder of her apartment rent in QC (PhP7,500.00/month, excluding utilities). Leaving it prematurely would be a breach of contract.

She does not want any (more) trouble. Life is hard as it is. What she just wants is for her agency to grant her Dislocation Pay to defray the expenses that the reassignments incurred.

Does her claim have weight? If Dislocation Pay is still in effect, can you please point me to an online link? There is no mention of it now online. Also, what are the grounds for an employee to be entitled to it and how many months does it usually cover?

Dear Ms. Lena,

This refers to your query regarding the reassignment of your co-employees. As a rule, there is no dislocation pay, it depends on the agency if they want to give a dislocation pay to their employees they reassigned. However, if the employee felt that her reassignment is a constructive dismissal, she should have filed an appeal with the CSC.
